GENERAL TERMS AND CONDITIONS  (GTC)

Scope of application
These General Terms and Conditions (GTC) are an integral part of all agreements and contracts in connection with the rental of tents and equipment.

Quotation
Our offers are subject to change and non-binding. Orders must be placed in writing. The order confirmation shall also be made in writing.

Rental prices
The rental price refers to the period between the assembly and dismantling of the rental object.
The rental prices are subject to VAT at the applicable rate.
The rental prices will be adjusted if:
– Ground pegs cannot be used for anchoring and therefore other fixings or ballast must be used.
– Access to the set-up area is not possible
– Not enough helpers are provided by the renter
– The ground is uneven – with our Tipi wooden floor, nothing is built underneath – it is laid on the ground and screwed down – it compensates for small unevennesses and holes, but not for a slope.

Requirements for setting up the tents
The pitch for the rented tents must be completely clear and level and free of debris or snow and ice at the time of pitching.
There must be no cable ducts, underground tanks or other concealed dangerous goods on the pitch, as the tents or the base plates are fixed to the ground with anchors. The tenant undertakes to make appropriate inquiries and to inform the landlord of the results.
If the set-up cannot be carried out on time due to unforeseen weather conditions (storm, snow, frost), the tenant cannot assert any claims.

Defects / damage
The tents are waterproof – however, due to the design, water may occasionally get in at certain points. You should not place any water-sensitive materials there – ask us about this – we will of course point this out to you.

We accept no liability for material in the tent – this is the sole responsibility of the hirer.

The tents and other equipment provided by the lessor are in perfect and usable condition. At the end of the rental period, the rented items must be returned in the same condition – this is a prerequisite for the repayment of the deposit. If damage is found on return, the lessor will retain the deposit and offset it against the costs of restoring the items to their original condition.

Cancellation
Cancellation of an order (termination of the contract) is possible in accordance with the following provisions. Cancellation must be made in writing.
In the event of cancellation, the hirer is obliged to pay compensation in accordance with the following scale:
Cancellation up to 2 weeks before the set-up date = 75% of the total amount. Cancellation within 2 weeks before set-up = 90% of the total amount.

Liability conditions
The landlord is liable for normal wear and tear of the rented property. Damage caused by culpable behavior on the part of the tenant or third parties shall be borne by the tenant.
The tenant may not make any changes or repairs to the rented property or have them made without the landlord’s consent. All consequences arising from this shall be borne by the tenant.

The tent scaffolding must not be used as a suspension device, especially not for heavy loads. Scaffolding parts and the floor must not be painted. The hirer must remove all adhesive residue from advertising material or similar before returning the tent. If the tarpaulins and floor or other parts of the tent are soiled, the hirer must bear the costs of restoring them to their original condition. Anyone who moves or removes structural parts, in particular struts and bracing, or relocates emergency exits or makes them unusable is liable to prosecution under building law. Should structural parts, roofing or coverings become loose or detached, the tenant is obliged to inform the landlord immediately or to initiate the necessary safety measures himself.
In the event of storm and thunderstorm danger, in particular from wind force 8, the hirer and guests must leave the tent and close it. (Instruction on handover)
In order to prevent theft and/or damage to the tent material or accessories, the hirer must ensure that the tent is guarded at his own expense. Liability begins with the handover of the rental object and ends with its return.

Insurance
The tenant has taken out insurance against liability for the rental object. The specified insurance cover does not extend to items brought in and consequential damage, for which compensation is excluded. As the Hirer is liable for all damage to property and personal injury caused by the operation and use of the rental object for which he is responsible, he must take out separate liability insurance and insurance against fire and storm damage. He must pay compensation for damaged or lost material.

Remuneration
The rental prices are generally determined separately for each order, even if they are taken from a rental price list. If the amount of additional services, such as transportation, assembly or cleaning work, is not specified, an appropriate fee shall be deemed to have been agreed.

Payment
The rental price is due in advance. We recommend paying at least one week in advance. The hirer is solely responsible for timely payment. If the total amount is not paid at least 2 days before the set-up date, the lessor reserves the right to set up the equipment.
In the case of long-term rentals, the lessor is entitled to terminate the rental agreement without notice if advance payments are not made. The tent location can then be entered without prior notice and the tent dismantled regardless of any occupancy.

Final provision
If any provision of a contract or agreement, including the GTC, set out herein is invalid or has not been effectively included in the contract, this shall not affect the validity of the other provisions.
The parties undertake to agree on a permissible provision as a substitute which comes closest to the economically intended one.
